Job Summary

The Commercial Director will lead, mentor and develop Contracts and Commercial staff supporting programs/contracts executed out of the Netherlands area.  Ensure Defense business line goals and objectives are fully supported and achieved. Lead contractual and commercial actions for assigned programs/contracts for Defense programs.  Provide beginning to end contractual and commercial guidance and planning based on analysis and interpretation of requirements and obligations; actively contribute to contractual and commercial strategy for program portfolio.  Ensure business compliance with statutory and GKN Aerospace governance.

Job Responsibilities

  • Ensure that contractual and commercial governance, policies and procedures, are adhered to for assigned portfolio, throughout contract lifecycle.
  • Lead contracts strategy for proposals including contract type, conduct terms analysis and  risk mitigation, including drafting of alternate terms, at proposal stage and throughout contract lifecyle.
  • Ensure alignment between customer contractual requirements and supplier contracts through completion of prime flowthroughs at proposal stage and throughout the contract lifecycle.
  • Lead preparation of contractual documents including, contracts, contract changes, letters of intent, other agreements such as, memorandums of understanding/agreement, teaming/strategic agreements, licensing agreements, and MRO agreements.
  • Work with Finance to maximize cash opportunities via contract financing and alternate methods.
  • Lead negotiation of key proposals, contract changes and disputes.
  • Work with Program Management and Finance to ensure customer debt is properly managed and customer overdue debt minimized.
  • Ensure that compliancy and contracting risk (technical, financial, contractual) is properly understood and managed in proposal preparation (including terms and conditions) and ensure that all contracting obligations are fully understood.
  • Responsible for initiating and managing order review process and acceptance in accordance with gated approval and management thereafter.
  • Responsible for managing contract changes, including identification, timely customer notifications, impact (cost and schedule), proposal submission and negotiation and incorporation into the contract. 
  • Ensure all contracts and contract amendments are uploaded to the Aerospace central contracts database.
  • Collect data and provide payment milestone overview and adherence to cash-in.
  • Support the claim process for customer claims and Material Litigation reporting and provide guidance on claim settlement and claim negotiation strategy.
  • Provide key management information and analysis to make informed business decisions and to help drive business performance improvement, particularly cost competitiveness and cash generation.
  • Contributes to the development and implementation of contractual and commercial strategies.
  • Manages the interface between GKN and its customers to resolve day to day commercial issues and build a strong customer relationship. 
  • Takes responsibility and accountability for the commercial performance of the program.
  • Mentor other members of the Contracts and Commercial team to increase the knowledge and skill base in US DOD Contracting

Job Qualifications

Required Qualifications

  • 20 years Defense and Aerospace experience   
  • Strong and demonstrable knowledge of US DoD contracting
  • Minimum of 15 years of experience working with FAR and DFARS
  • Experience with direct USG, Prime Customer and Commercial Contracts
  • Must be a US Persons (US Citizen, Green Card Holder / US permanent resident, refugee or asylee) to meet export control compliance requirements
